Introduction
TeDomum provides accessible applications through the Internet (the Services), intended primarly to main functions such as collaboration, communication and publishing. These Services are made available to natural and legal people (the Users) who use them to collaborate, communicate or to publish information, including technical information.
This document is the Terms and Conditions of Use (TCUs) of the aforesaid Services, applicable to TeDomum and its Users. It defines the rights granted by TeDomum to its Users, in particular with regard to the rights related to their personal data and the use limitations of the Services. It also defines the TeDomum moderation policy, detailing the major infractions and resulting actions when TeDomum is informed of these infractions.
By using these Services to collaborate, communicate, or to publish information, the Users acknowledge having read and agreed to be bound by these TCUs. TeDomum recognises to be bound to its Users by these same TCUs. These TCUs may be updated, in which case the update and the differences will be mentionned on the TeDomum news feed.
The failure of one of the parties to use its rights or to abide by these Terms does not constitute a waiver. These Terms constitute the entire agreement between TeDomum and its users, replacing any previous agreement.
The content of these TCUs is free of rights and can be reused for any purpose, without notification or mention.
General principles
TeDomum is a French nonprofit association, under French law, whose services are hosted exclusively in France. Therefore, TeDomum is subject to French law, whick takes precedence in all decisions.
TeDomum considers the Users as innocent of any infraction unless there is material or moral evidence of an offense committed on the Services, as defined by French law or the law specifically applicable to the Users according to their nationality or domicile, or by these TCUs.
TeDomum does not a priori consult the information shared or published by Users on the Services. Therefore, the Users are responsible for their activity on the Services ; if an infraction is found, TeDomum is only held responsible only from the time TeDomum is informed of the situation by an User, a Member of the association, or a third-party (visitor, adminstration, …).
Users are responsible for the security of their personal accounts on the Services, excluding the security aspects inherent in the infrastructure and application. In particular, the User is responsible for the security of its access password. TeDomum is responsible for the security of the hosting infrastructure and applications.
Access to Services by the User is user-iniated and free of charge. Donations made to TeDomum do not constitute payment for use of these Services. The Services are provided “as is” with no guarantees regarding minimum availability or data retention.
A service can be terminated in one of the following ways:
- initiated by the User, when the Service allows it or upon request without specifying any reason for termination ;
- initiated by TeDomum, when there is a failure to comply with these TCUs. In this case, the reason must be notified to the relevant user by any available means of contact ;
- due to expiration of use, after a 24-month inactivity period. The User has been notified at least 2 times within the last 22 months inactivity by any available means of contact, unless the User has previously indicated that their use will not expire.
Communication with TeDomum
A request for the exercise of the rights defined by these TCUs may be addressed to any point of contact defined on this page.
TeDomum does not force its Users to provide their real identity to access to the Services. Also, for the safety of the Users, any request relating to the Services that couldn’t be authentificated through these Services (for example : a request for data deletion or a lost password recovery) would not be processed without reasonable proof of identity from the applicant.
TeDomum n’oblige pas les Utilisateurs à fournir leur identité réelle pour accéder aux Services. Aussi, par mesure de sécurité pour les Utilisateurs, toute demande relative aux Services qui ne pourrait être authentifiée par le biais de ces Services (par exemple une suppression de données ou une récupération de mot de passe perdu) ne saurait être traitée sans que le demandeur fournisse une preuve raisonnable de son identité d’Utilisateur. Three criteria are applied :
- the User provided a personal email address and uses it to communicate without suspicion of fraudulent access by TeDomum.
- the User provided their real natural or moral identity during registration and has subsequently justified this identity upon request.
- the user, whose internal documentation is retained by the association, mentions an email address (for example, in reference to registration for a service that does not allow reference to the profile) and uses this email address to communicate.
An email address means any electronic means of communication whose access is authenticated, such as an e-mail address, a “Matrix” address, a “Jabber” address or an authenticated “IRC” host. As such, a non-authenticated courier service or an IP address cannot constitute an electronic address.
Management of infractions
In accordance with Act 2004-575 (under French law), which fosters confidence in the digital economy, and following the establishment of an offense to the TCUs, TeDomum will remove any content deemed in violation of French law. In the event of a breach concerning a content publication attribute, TeDomum may modify the content published by warning the user. For example, the necessary warnings for the public may be inserted. Each deletion is subject to public notification and individual notification to the User who has published the content. If the illicit character is not established, TeDomum will notify the user who published the content during the instruction phase.
TeDomum distinguishes two categories of offences:
- infringements of the person shall affect any action intended or effect of impairing the physical or psychological integrity of others;
- damages to property shall be in respect of any action intended or effect to affect the integrity of common property or property owned by others.
After the offence was established, if the User was not aware of the offence at the time of the incident, TeDomum warned and sensitized him. Otherwise, TeDomum will banish the account, possibly with a banishment date of seven (7) days in the case of property offences.
When a user submits a wish to commit an offense, TeDomum will systematically proceed to permanently close the account, possibly issuing a definitive ban on all of the user’s accounts or terminating the accounts in question.
If the offense involves all of the user’s content, TeDomum will terminate the account.
If the offense relates to content that has not been published on TeDomum services (e.g., via a federation protocol or automatic data import), TeDomum will notify the publication manager. If the content is to be deleted and the responsible person does not intervene within 48 hours, TeDomum acts based on technical possibilities and in the following order of preference: masking the specific content, blocking the user, and blocking the host. Similarly, when an offense would justify banning a user, TeDomum proceeds in order of preference: blocking the user or blocking the host.
The main cases of offense are defined and must be followed. Any other offense under French law may be characterized independently of its registration in the TCUs.
Offenses to the person
Insult, contempt, defamation: words or content accompanied by a desire to injure, including insults based on discrimination or sexist insults.
Incitement to hatred: words or content inciting hatred, violence or insult towards other people because of their origin, beliefs or any discriminatory trait.
Apology or provocation of terrorism: words or content in favor of acts of terrorism, inciting others to carry out such acts or facilitating the carrying out of such acts, including making such content available.
Hate speech: hate speech or content directed at an individual or group of individuals, not otherwise characterized as insult, contempt, defamation or incitement to hatred.
Discriminatory remarks: devaluing remarks or content using discriminatory references, not otherwise characterized as insult, contempt or defamation, in particular reference to current or historical racist activities, vocabulary or reference to any discrimination due to origin, beliefs or any other personal trait.
Pedophilia, child pornography: pornographic content showing or representing minors, including making such content available.
Representation of the body: pornographic content or shocking representation of the body without prior warning.
Explicit violence: content explicitly depicting violence against people without prior warning.
Implicit violence: content suggesting violence against people without explicitly representing it and without prior warning, in particular the representation of weapons by design, reference to real or fictitious acts of violence.
Representation of addictions: comments or content suggesting situations that may involve addictions without prior warning, in particular references to alcohol, all forms of addictive drugs and gambling.
Self-representations: explicit self-representations without prior warning that may cause others to feel ill-at-ease in terms of their self-perception or interpersonal relationships.
Disinformation/Fake news: statements or content presenting a dangerous nature for an individual or a group (medical, biological, economic, legal, security risks) without explicit mention of the risk, or contextualized or supported in a manifestly false manner without explicit mention of the limits or biases.
Property offences
Attempted scams: statements or content intended to defraud others, including references to such content.
Dissemination of personal information: non-legitimate dissemination of personal information of non-consenting individuals.
Infringement of copyright: total or substantial reproduction of works without a license from their author, including making such content available, with the exception of pastiche, satire, criticism and quotation.
Dissemination of protected information: non-legitimate dissemination of administratively protected information without the consent of the sender.
Spam: repetitive content harmful to the publication of other content, potentially posing a risk to the distribution platform.
Processing of personal data
TeDomum acknowledges that users have full rights regarding their personal data, including the rights to object, access, rectify, and delete. To exercise these rights, users must contact TeDomum using the methods defined above.
Nominal processing of services
Chaque Service opéré par TeDomum au profit des Utilisateurs constitue un traitement de données obligatoire pour l’emploi du Service.
Dans ce cadre, TeDomum traite, exclusivement sous droit français et sur le territoire français, toutes données mises à disposition explicitement par l’Utilisateur pour le propos du fonctionnement nominal du Service tel que proposé à l’Utilisateur, pour la durée d’emploi du Service par l’Utilisateur ou toute durée définie explicitement par l’Utilisateur, avec pour finalités :
- la collaboration entre les Utilisateurs ;
- la communication entre les Utilisateurs ou avec des tiers ;
- la publication d’informations par les Utilisateurs ;
- l’authentification d’une demande adressée par l’Utilisateur à TeDomum.
Ces données sont accédées uniquement par le Service, par l’Utilisateur, ses collaborateurs ou interlocuteurs dans le cadre des services de communication et collaboration, par ses visiteurs dans le cadre des services de publication, et par TeDomum dans le cadre de l’application des CGU.
TeDomum supprime les données relatives à l’usage du ou des Services après la résiliation :
- sans délai sur demande de l’Utilisateur ;
- après un délai de un (1) an sans accès à la donnée, s’agissant d’usages de publication ;
- après un délai de un (1) mois pour les autres données ;
- à la discrétion de TeDomum lorsque les conditions techniques le justifient, y-compris en conservant une archive soumise aux mêmes conditions de suppression.
En outre, TeDomum supprime après six (6) mois les données utiles à l’usage mais non générées par l’Utilisateur, telles que les données de mise en tampon de contenus de services tiers (fédération, etc.)
Traitement d’authentification centralisée
TeDomum opère au profit des Utilisateurs un service d’authentification centralisée nommé Hiboo, constituant un traitement de données obligatoire pour l’emploi des Services y recourant.
Dans ce cadre, TeDomum traite, exclusivement sous droit français et sur le territoire français, les authentifiants (nom d’utilisateur, mot de passe, éventuels autres facteurs) et les adresses électroniques de contact déclarés par l’utilisateur, pour la durée de validité du compte de l’Utilisateur, avec pour finalités :
- l’authentification de l’Utilisateur sur les Services recourant à Hiboo ;
- la transmission de notifications à l’Utilisateur concernant l’emploi des Services recourant à Hiboo ;
- l’authentification d’une demande adressée par l’Utilisateur à TeDomum.
Ces données sont accédées uniquement par l’Utilisateur dans le cadre de l’authentification aux Services et par TeDomum dans le cadre de l’application des CGU. Ces données sont supprimées dès la résiliation.
Traitement des journaux des Services
Chaque Service opéré par TeDomum au profit des Utilisateurs génère des journaux techniques, dont la conservation et la consultation par TeDomum constituent un traitement de données obligatoire pour l’emploi du Service.
Dans ce cadre, TeDomum traite, exclusivement sous droit français et sur le territoire français, l’ensemble des journaux générés par les Services, pour une durée de quatorze (14) jours à compter de leur génération, avec pour finalités :
- la recherche et la correction de problèmes techniques liés aux Services ;
- la contribution aux actions de modération afin de rechercher les actions liées à une infraction constatée ;
- la mise à disposition des traces d’accès aux Services dans le cadre d’instructions judiciaires dans les conditions définies par le droit français.
Ces données sont consultées exclusivement par les administrateurs de TeDomum, exclusivement sur les serveurs les ayant générées ou sur les dispositifs de collecte de journaux opérés par TeDomum.
Conformément au code des procédures pénales, TeDomum peut être soumis à des réquisitions judiciaires portant notamment sur des journaux d’accès aux Services. L’ensemble de l’infrastructure de TeDomum est régi par la législation française et TeDomum répond exclusivement aux réquisitions originaires des services de police ou associés en France. La légitimité des réquisitions est vérifiée avant toute communication et seules les données requises sont communiquées. Les Utilisateurs concernés par la communication sont notifiés individuellement si les conditions légales le permettent.
Traitement de documentation interne
TeDomum opère, à son profit exclusif, une documentation interne pouvant porter sur des données personnelles, constituant un traitement de données facultatif pour l’emploi des Services.
Dans ce cadre, sur consentement explicite obtenu lors de la configuration spécifique d’un Service au profit d’un Utilisateur, TeDomum peut conserver l’information d’identité sur la personne physique, la personne morale de l’Utilisateur et les adresses de contact électronique déclarées par l’Utilisateur, pour la durée d’emploi du Service par l’Utilisateur, avec pour finalités :
- la transmission de notifications à l’Utilisateur concernant l’emploi des Services recourant à Hiboo ;
- l’authentification d’une demande adressée par l’Utilisateur à TeDomum.
Ces données sont consultées exclusivement par les membres de l’association TeDomum dans le cadre de l’application des CGU. Ces données sont supprimées dès la résiliation de l’usage.
